Please carefully read the following Terms of Use before using the Poncho Company Web site (the "Site"). By accessing this Site, you agree to be bound by these Terms of Use. These Terms of Use may be updated from time to time. Accordingly, you should check the date of the Terms of Use (which appear at the end of this document) and review any changes since the last version. If at any time you do not agree to these Terms of Use, please do not use this Site. This Web site is operated by PACIFIC HOME GMBH.  Throughout the site, the terms "we", "us" and "our" refer to PACIFIC HOME GMBH. PACIFIC HOME GMBH offers this Web site, including all information, tools and services available from this site, to you, the user, conditioned upon your acceptance of all the terms, conditions, policies and notices stated here. Your continued use of this site constitutes your agreement to these Terms of Use. 

EXECUTION OF THE CONTRACT

All offers made by PACIFIC HOME GMBH are non-binding. A contract between the customer an PACIFIC HOME GMBH becomes effective only after the customer has placed an order and PACIFIC HOME GMBH has accepted it. The customer generates his order online by completing the order form provided by PACIFIC HOME GMBH on the website of www.ponchocompany.com. PACIFIC HOME GMBH signifies its acceptance of the order by delivering some or all of the products.

PAYMENT/SHIPPING COSTS

All prices are retail prices in Swiss Francs (SFR) including Swiss VAT. Shipment will be charged separately and incl. Swiss VAT. Duties and Taxes (VAT and Sales Tax) for international deliveries (outside Switzerland) will be payed by PACIFIC HOME GMBH.

DELIVERY

  • Please allow 2 - 5 working days for international shipping outside of Switzerland.
  • The delivery dates are without obligation.

RETURN POLICY

  • All returns will be credited to the original form of payment. Original shipping charges are not refundable.
  • Please allow 15 business days for us to process your return.
  • The full amount will be credited to the original tender if returned within 14 days of the ship date on your invoice and accompanied by the original invoice.
  • Please note that all items are equipped and sent with single-use labels. If the item is used, worn, washed, dry cleaned, damaged or no longer has the label properly attached, PACIFIC HOME GMBH has no obligation to take the item back. 
  • Please use the original shipping box and packing materials.

WARRANTY

Because our products are items of daily use, any representations and warranties of Pacific Home GmbH are excluded. Other claims for damages and indemnity are ruled by the provisions of Swiss law.

ORDERS AND RESELLING

The information on this site does not constitute a binding offer to sell products described on the site or to make such products available in your area. We reserve the right at any time after receipt of your order to accept or decline your order, or any portion thereof, in our sole discretion, even after your receipt of an order confirmation or after your credit card has been charged. You may not purchase any item from this site for resale by you or any other person, and you may not resell any item purchased from this site.

USE OF THE MATERIAL ON THE SITE

All content on this site (including, without limitation, text, design, graphics, logos, icons, images, audio clips, downloads, interfaces, code and software, as well as the selection and arrangement thereof), is the exclusive property of and owned by PACIFC HOME GMBH and is protected by copyright, trademark and other applicable laws. Any use of content on the site, including but not limited to the modification, distribution, transmission, performance, broadcast, publication, uploading, licensing, reverse engineering, transfer or sale of, or the creation of derivative works from, any material, information, software, products or services obtained from the site, or use of the site for purposes competitive to PACIFIC HOME GMBH, is expressly prohibited.

JURISDICTION

Should one ore more of the provisions ot these GTO cease to apply, this does not invalidate the entire contract. Any provisions, which become inapplicable, will be replaced with appropriate new provisions under the relevant jurisdiction. Solely Swiss law governs this contract. Place of Jurisdiction: 7270 Davos, Switzerland

PRODUCT PACKAGING

Warning: Due do negligent or wrong handling, plastic bags, polybag packing or the product itself can be dangerous. To avoid danger of suffocation keep plastic packaging bags, polybag packing or the product itself away from babies and children.
